As Justice John Tsoho, the judge that has been presiding over the phantom treasonable felony case brought against Nnamdi Kanu by the Nigerian government, buckles under immense pressure mounted by the Indigenous People of Biafra (IPOB), Kanu the IPOB leader has demanded for his investigation and sack from the judiciary.

In the video video, Kanu who was being briefed by his lawyers on petitions fired against the judge, Kanu queried in Igbo, [when they will sack the judge. According to Kanu, Biafra is fighting for truth and corruption and will expose corruption wherever it resides, including in the Nigerian judiciary.

"Wherever we see corruption, we fight corruption. It doesn't matter who is involved. That's why we are IPOB.

Continuing after the lawyer stated that they told the judge he was being teleguided from the Aso Rock villa and were prepared to the case to international court where kanu can get justice, Kanu retorted:

Ke mgbe aga acchu ya n'oru? [When will he be sacked as a judge] I want him to be sacked as a judge.

Nnamdi Kanu dazzles in Abuja court as he wins a crucial battle

Kanu had written a petition against Tsoho to the NJC accusing him of “committing judicial rascality” over two rulings given against him. In the petition signed by one of his counsel, Ifeanyi Ejiofor, Kanu called for an investigation into the rulings of the court over the permission granted the Department of State Services (DSS) to protect its witness in his trial. Ejiofor said the conduct of the judge in the trial of his client was a fundamental breach of his judicial oath. Kanu also called for a correction of the actions of the judge in accordance with the Oath Act. 

Kanu’s lead counsel, Mr Chuks Muoma (SAN), stated at the resumed trial on Monday in Abuja, that the court was biased in the manner it had so far handled the case. Muoma, in his application told the court that his client had petitioned the National Judicial Council (NJC) over the claim. He said that it would only be proper for the court to suspend hearing of the case pending the outcome of the investigation by the NJC. 

“Following the development, all we are asking this court to do is to hands off the case since my client has lost confidence in this court; pending the outcome of the NJC investigation. 

“It would not be proper for the court to continue with this matter when investigation is ongoing. 

“So, in the interest of justice, I would urge the court to transfer the matter; I would suggest that it be sent back to the CJ,’’ Muoma said.

Tsoho disqualified himself from the case following a petition sent to the NJC. In a short ruling, Tsoho held that he has no personal interest in the case saying that since the defence lacked confidence in the court, it was only “reasonable” for the court to disqualify itself from the case. “Accordingly, this case is hereby forwarded to the Chief Judge for further reassignment’’, Tsoho said. 

In his ruling today, Monday, September 26, Tsoho said: “I deem it unnecessary to allow the learned DPP (director of public prosecution) M. Labaran to make any response.”

The judge however said any action by the court would preempt the decision of the judicial council. He also said the defense team is focused on stampeding the court before the decision of the NJC. He further announced that he will no longer preside over the matter stating that the essence of justice is based on confidence in the court by all parties involved.
